LHC Acquits Death Row Prisoner in Murder Case

The Lahore High Court (LHC) on Saturday acquitted Muhammad Farhan, who was sentenced to death in a murder case, after setting aside the death sentence and ordering his immediate release from prison. A two-member bench comprising Justice Farooq Haider and Justice Ameer Ajam Khan issued a 19-page written verdict on Muhammad Farhan's appeal against his conviction and death sentence. The court observed that the prosecution had failed to prove the case beyond a reasonable doubt and that the statements of witnesses produced by the prosecution were not reliable. According to the verdict, Muhammad Amjad was allegedly murdered with a blow from an iron rod. The case was registered at the Nishatabad Police Station, Faisalabad, on September 24, 2022, while the Sessions Court, Faisalabad, had sentenced Muhammad Farhan to death on March 30, 2023. The High Court noted contradictions in the prosecution record and a delay in the registration of the First Information Report (FIR). The court also observed that the testimonies of the deceased's son and brother were questionable, as the witnesses could not provide a satisfactory explanation for their presence at the factory at the relevant time. The verdict further noted that no reasonable explanation had been provided for the delay in submitting police documents for the post-mortem examination. The court also found the USB drive produced as evidence unreliable and observed that the prosecution had failed to establish a motive for the alleged murder. After examining the evidence and the case record, the Lahore High Court set aside Muhammad Farhan's death sentence, acquitted him, and ordered his immediate release.
