The Supreme Court (SC) on Friday granted post-arrest bail to 78-year-old and ailing accused Nadir Khan in a murder case, setting aside the decision of the Peshawar High Court. A three-member bench headed by Justice Jamal Khan Mandokhail and comprising Justice Naeem Akhtar Afghan and Justice Aqeel Ahmed Abbasi, issued the judgment. The court observed that no weapon had been recovered from the accused and that the cartridges recovered from the crime scene appeared to have been fired from the same pistol.
Therefore, there was room for further investigation into the accused's role. The court noted that the 78-year-old accused suffers from a heart condition, diabetes and hypertension, and that the lack of adequate medical facilities in prison could pose a serious risk to his life. The court further observed that the FIR contained a joint allegation of firing against the accused and his sons, but his individual role in causing the specific fatal injuries had not been clearly established.
