PHC to Hear Pleas Seeking Recovery of Afridi and Swati on Tuesday

The Peshawar High Court (PHC) has officially fixed for hearing the petitions seeking the urgent recovery of Khyber Pakhtunkhwa Chief Minister Muhammad Sohail Afridi and Provincial Assembly Speaker Babar Saleem Swati. The judicial proceedings are scheduled to commence on October 20, as the legal teams prepare to present their arguments before the bench.

A writ petition filed by Muhammad Aamir Afridi, the brother of the Chief Minister, alleges that Muhammad Sohail Afridi was forcibly abducted by a group of armed and masked individuals. The petition highlights the gravity of the situation, noting that the disappearance of the province's top elected official has created a constitutional vacuum and widespread public concern across the region.

The petitioner argued that the abduction of the province's elected chief executive constitutes a serious violation of the Constitution, the rule of law, and fundamental human rights. He emphasized that such actions undermine the democratic process and the stability of the provincial government, demanding an immediate judicial intervention to ensure the safety of the abducted leaders.

Furthermore, the legal counsel for the petitioners stated that Sohail Afridi's life and personal liberty are under severe threat. The court has been requested to issue directives to the relevant law enforcement agencies and provincial authorities to ensure his immediate recovery and production before the bench to clarify the circumstances surrounding his disappearance.

Simultaneously, the petition regarding Speaker Babar Saleem Swati raises similar concerns regarding his whereabouts and safety. The court is expected to examine the reports submitted by the provincial administration and police regarding the security situation and the efforts made so far to locate the missing officials.

Political analysts suggest that the hearing on October 20 will be a critical test for the judiciary in upholding the supremacy of the law. The legal fraternity has expressed solidarity with the families, calling for a transparent investigation into the incidents that have led to the current political uncertainty in Khyber Pakhtunkhwa.

The PHC bench is expected to issue notices to the federal and provincial interior ministries, as well as the Inspector General of Police, to provide a detailed account of the security measures taken. The court's decision will be closely watched by stakeholders as the province navigates this unprecedented political crisis.

As the date for the hearing approaches, security has been tightened around the court premises to manage the expected influx of supporters and legal observers. The petitioners remain hopeful that the judiciary will provide the necessary relief to ensure the safe return of the Chief Minister and the Speaker.

The provincial government has yet to issue a formal statement regarding the specific details of the abduction, but sources indicate that high-level consultations are underway to address the legal challenges posed by these petitions. Probes Pakistan will continue to monitor the situation closely as further updates emerge from the Peshawar High Court regarding these high-profile cases.
