Senate Polls in KP Won't Take Place if Emergency Continues: Gohar

Pakistan Tehreek-e-Insaf (PTI) Chairman Barrister Gohar Ali Khan has confirmed to this correspondent that Senate elections in Khyber Pakhtunkhwa will not take place if the emergency and Governor's Rule continue in the province until the scheduled polls in March next year. The confirmation comes amid uncertainty over the fate of 12 Senate seats allocated to the province, where the PTI holds a majority in the provincial assembly, which has been rendered non-functional following the imposition of Governor's Rule on October 11.

The Senate elections are scheduled for March 2027, when 48 senators are due to complete their six-year terms. Of these, 12 seats are to be filled through elections by the KP Assembly.

The continuation of emergency arrangements could therefore complicate the election of the province's new senators, potentially leaving its representation in the Upper House unresolved when the new Senate term begins. Barrister Gohar lamented that this would be the second time in a row that elections in KP would not be held on time.

In 2024, the Senate elections were also not held due to the reserved seats allocation controversy. The issue carries particular political significance because the PTI commands a majority in the KP Assembly, while the Pakistan Muslim League-Nawaz (PML-N), Pakistan Peoples Party (PPP) and their allies hold a majority in the federal Parliament.

Under the normal constitutional arrangement, senators representing the provinces are elected by their respective provincial assemblies through proportional representation by means of the single transferable vote. However, Article 234 of the Constitution provides for Parliament to exercise the powers of a provincial assembly under a proclamation.

The precise legal implications of this provision for the election of senators from a province under Governor's Rule remain a matter requiring clarification. The six-month constitutional limit on a proclamation under Article 234 also makes the timeline significant.

Governor's Rule was imposed in KP on October 11, 2026, while the Senate elections are scheduled for March 2027. The possible absence of newly elected senators from KP could affect the composition of the Upper House following the retirement of the 48 outgoing members.

The Senate chairman and deputy chairman are elected by senators, meaning any change in the house's composition could also have implications for the subsequent leadership contest. The Election Commission of Pakistan's (ECP) position on the conduct of the KP Senate elections under the prevailing arrangement will be crucial in determining how the constitutional electoral process proceeds if the provincial assembly remains non-functional.
